Privacy Policy
Effective Date: June 10, 2026 · Last Updated: June 10, 2026
This Privacy Policy explains how Commitle ("Company," "we," "us," or "our") collects, uses, and protects information you provide when you visit our website, submit an inquiry, or engage with our services — including our AI-powered SMS automation systems. We are committed to protecting your privacy and complying with applicable data protection laws, including the Telephone Consumer Protection Act (TCPA) and applicable state privacy laws.
1. Information We Collect
1.1 Information You Provide Directly
When you submit a contact form, request a consultation, or engage with our services, we may collect:
- Identity information: Name, job title, company name
- Contact information: Email address, mobile phone number, mailing address
- Service information: Details about your project, lead database size, business needs, and current processes
- SMS consent records: Timestamp, IP address, and form data associated with your opt-in to receive SMS communications
- Communications: Content of messages, emails, and inquiries you send us
1.2 Information Collected Automatically
When you visit our website, we may automatically collect:
- Log data: IP address, browser type and version, pages viewed, time and date of visits, referring URL
- Device data: Device type, operating system, screen resolution
- Cookie data: Session identifiers and preference settings (see Section 8 for details)
1.3 Information from Third Parties
We may receive information about you from third-party sources such as lead enrichment services, social media platforms (if you contact us via social media), or client-provided databases used in AI automation services.
2. How We Use Your Information
We use the information we collect to:
- Respond to your inquiries and provide requested information
- Deliver, manage, and improve our software development and AI automation services
- Send SMS messages you have expressly consented to receive
- Schedule and confirm consultations and appointments
- Send transactional emails and service updates related to your engagement
- Analyze website usage to improve our website and user experience
- Comply with legal obligations and enforce our Terms of Use
- Protect the security and integrity of our services
We do not use your personal information for automated decision-making that produces legal or similarly significant effects without human review.
3. SMS Messaging and TCPA Compliance
3.1 SMS Opt-In and Consent Records
When you check the SMS consent checkbox on our contact form, we record your consent with a timestamp, your IP address, and the specific consent language you agreed to. This record is maintained for compliance purposes in accordance with TCPA requirements and A2P 10DLC carrier registration obligations.
3.2 Types of SMS Messages We Send
If you have opted in, you may receive the following categories of SMS messages from Commitle:
- Initial inquiry responses and follow-up communications
- Appointment scheduling, confirmations, and reminders
- Service updates and transactional notifications relevant to your engagement
- Responses to questions or requests you initiate via SMS
We do not send unsolicited marketing blasts. All SMS communications are tied to an express opt-in and a legitimate business purpose.
3.3 Opt-Out
You may opt out of SMS communications at any time by replying STOP to any message from us. We will send one final confirmation message and will cease further SMS contact unless you re-opt-in. Opting out of SMS does not affect your ability to receive email communications or use our services.
3.4 A2P 10DLC Infrastructure
All SMS messages sent by Commitle are delivered through registered A2P 10DLC numbers that are approved by The Campaign Registry (TCR) and compliant with major US carrier requirements. This registration ensures message deliverability and protects recipients from spam.
3.5 SMS Messaging for Client Automations
When Commitle builds AI SMS automation systems for clients, the client is the data controller for all customer data processed through those systems. Commitle acts as a data processor in that context and processes data only in accordance with the client's documented instructions and applicable law. Each client automation maintains its own A2P 10DLC registration and consent records.
4. Legal Bases for Processing
We process your personal information on the following legal bases:
- Consent: For SMS communications and any optional marketing communications, based on your express opt-in
- Contract performance: To deliver services you have engaged us for
- Legitimate interests: For website analytics, fraud prevention, and improving our services, where these interests are not overridden by your rights
- Legal obligation: To comply with applicable laws and regulations
5. How We Share Your Information
We do not sell, rent, or trade your personal information. We may share your information only in the following limited circumstances:
- Service providers: Trusted third-party vendors who assist in operating our website, delivering SMS services (such as SMS platform providers), processing forms (Netlify), or providing cloud infrastructure — all bound by data processing agreements
- A2P 10DLC registration: Necessary business information is shared with The Campaign Registry (TCR) and carriers as required for SMS campaign registration
- Legal requirements: When required by law, subpoena, or other legal process, or to protect the rights, property, or safety of Commitle, our clients, or the public
- Business transfers: In connection with a merger, acquisition, or sale of all or a portion of our assets, with appropriate confidentiality protections
We never share SMS opt-in data or consent records with third parties for their own marketing purposes.
